This Rental Agreement (“Agreement”) is between Talo Stays LLC (“Talo Stays,” “we,” “us,” “our”), a Michigan limited liability company, and the individual who submits the reservation and each additional occupant listed on it (“Guest,” “you,” “your”). By completing your reservation and providing an electronic signature, you agree to the terms below.<\/p>\n\n\n\n
This Agreement applies to the property identified in your booking confirmation (the “Property”), together with its furnishings, amenities, and any shared spaces described in the Property’s listing.<\/p>\n\n\n\n
Your check-in and check-out dates, rental rate, number of guests, pet fees (if applicable), cleaning fee, taxes, security deposit or damage protection fee (if applicable), and cancellation policy are set at the time of booking and stated in your booking confirmation. Those terms are incorporated into this Agreement by reference. If anything in your booking confirmation conflicts with this Agreement, the booking confirmation controls for that specific term.<\/p>\n\n\n\n
Check-in and check-out times are property-specific and included in your pre-arrival communication. Please check in and out within the windows provided \u2014 early or late requests are handled case by case and are not guaranteed.<\/p>\n\n\n\n
The Guest who books the reservation must be at least 21 years old, present for the entire stay, and responsible for all registered occupants.
Note: on reservations booked through Airbnb, Airbnb’s own platform policy permits guests 18 and older to complete a booking, and does not allow hosts to raise that minimum at the time of booking. Talo Stays’ 21-and-older policy is enforced through this Agreement and Talo Stays’ right to decline or cancel a non-conforming reservation, rather than at the Airbnb booking step itself. On direct bookings and other platforms without an equivalent restriction, this 21-and-older requirement applies at booking.
Only the number of guests stated on your reservation may stay overnight at the Property. Exceeding the stated occupancy limit is a material breach of this Agreement and may result in additional charges or immediate termination of the stay without refund.<\/p>\n\n\n\n
Guest agrees to:
Use the Property for lawful, residential purposes only.
Not host parties, events, or gatherings beyond the registered guests, at any Talo Stays property, at any time.
Not smoke inside any Property. Where outdoor smoking is permitted, dispose of materials responsibly and away from structures.
Follow the pet policy stated in the booking confirmation \u2014 pets are only permitted where the listing states pets are allowed, and any pet fees apply as quoted at booking.
Comply with posted house rules, quiet hours, and any community or HOA rules that apply to the Property.
Not exceed the stated occupancy limit.
A violation of this section is grounds for immediate termination of the stay without refund. Guest may also be charged an unauthorized-event or violation fee, in the amount stated in the booking confirmation or property house rules, in addition to any resulting damages.<\/p>\n\n\n\n
Guest is responsible for any damage to the Property, its furnishings, or shared amenities beyond normal wear and tear that occurs during the stay. Where a security deposit or damage protection fee applies, its amount and terms are stated in the booking confirmation. Talo Stays may charge the payment method on file for damage, missing items, excess cleaning, or an unauthorized pet discovered after checkout, and will provide an itemized explanation on request.<\/p>\n\n\n\n
Cancellation and refund terms depend on the property and the platform through which you booked, and are stated in your booking confirmation at the time of reservation. Please review those terms before booking. Talo Stays does not apply a single company-wide cancellation policy across all properties and platforms.<\/p>\n\n\n\n
Many Talo Stays properties include outdoor and waterfront features \u2014 beaches, docks, fire pits, and similar amenities \u2014 that carry inherent risk. To the fullest extent permitted by Michigan law, Guest voluntarily assumes all risk of injury, loss, or damage arising from use of the Property and its amenities, including waterfront and outdoor areas, for Guest and all registered occupants and their invitees.<\/p>\n\n\n\n
To the fullest extent permitted by law, Guest releases Talo Stays LLC, the Property owner, and their respective members, employees, and agents from any claim, liability, injury, or loss arising from Guest’s stay, except to the extent caused by their gross negligence or willful misconduct. Guest agrees to indemnify and hold Talo Stays harmless from claims arising out of Guest’s, or Guest’s invitees’, violation of this Agreement or applicable law.<\/p>\n\n\n\n
Talo Stays or its representatives (including maintenance and cleaning staff) may enter the Property during a stay to address maintenance, safety, or emergency issues, and will make reasonable efforts to notify Guest in advance except in an emergency.<\/p>\n\n\n\n
Guest may not sublet, re-rent, or assign this Agreement or the reservation to any other party.<\/p>\n\n\n\n
Talo Stays is not responsible for Guest’s personal property left at or lost from the Property. Items found after checkout will be held for a reasonable period and returned at Guest’s expense on request, where reasonably possible.<\/p>\n\n\n\n
Talo Stays is not liable for a cancellation, interruption, or diminished condition of a stay caused by events outside its reasonable control, including severe weather, natural disaster, government order, or utility failure. In such cases, Talo Stays will work in good faith with Guest on rebooking or refund options where appropriate.<\/p>\n\n\n\n
Guest agrees to comply with all applicable federal, state, and local laws, and any short-term rental regulations applicable to the Property’s jurisdiction, during the stay.<\/p>\n\n\n\n
This Agreement is governed by the laws of the State of Michigan, without regard to conflict-of-law principles. Any dispute arising from this Agreement will be resolved in the state or federal courts located in Michigan, unless otherwise required by law.<\/p>\n\n\n\n
If any provision of this Agreement is found unenforceable, the remaining provisions remain in full force and effect.<\/p>\n\n\n\n
This Agreement, together with the booking confirmation and any property-specific house rules provided at booking, is the entire agreement between Guest and Talo Stays LLC regarding the stay, and supersedes any prior communications on these terms.<\/p>\n\n\n\n
By submitting your reservation and providing your electronic signature, you acknowledge that you have read, understood, and agree to this Rental Agreement on behalf of yourself and all registered occupants of the reservation.<\/p>\n","protected":false},"excerpt":{"rendered":"
